  • Bossland GmbH sues Blizzard for intransparent, surprising and incomprehensible TOS and EULA

    Today, the 9th January 2012, we are informing you that we filed a lawsuit against Blizzard.

    The lawsuit says that TOS and EULA never where part of the purchase contract, that TOS and EULA are intransparent, surprising and incomprehensible.

    We chose the court in Berlin / Germany. There is not much to say now, we are simply asking the court to decide in a declaratory action if the terms apply or do not apply.

      But doesn't the box you buy wow from say that a battle.net account is required which implies you must agree to all terms and conditions that are needed to register a battle.net account? And the battle.net ToS and EULA includes WoW's. But it is not directly printed on the box that you must accept a ToS and EULA

      it is indeed true that:
      1 the day I purchased WoW the Eula was completely different and I cant play a game I bought if I dont agree later on.
      2. they fully are aware that their target audience are minors, who cant be asked to be able to( fully) understand(and arent legally responsible) the legal talk (yay lets ask my lawyer for advice before I can play this can game lol). So basically to present such a eula to a minor audience( for a part) is just ridiculous.
      3. many more issues which are pretty strange/ ridiculous / wrong..not going into that, going to play around with HB

      pretty sure it was found in glider v blizzard that when you buy the game, youre not actually owning a copy of the game, rather you're owning a "license" to play and that license is subject to whatever ToS blizzard makes, and without notice.

      Its a game. Bottom line. A judge will look at it like a game. Especially in a country that isn't ran by a corrupted government such as the U.S. where legal loopholes are rampant and council can just get away with about anything they desire... But they seem to think they can pull the same shit in Germany? HAHA good luck Blizz you're gonna lose!!! And I FEEL IT.

      Its a game as every one else here say becuse they advertise it as a game so if they against the odds will
      Claim that its a license you buy then they back stabbing them self becuse then they can be sued
      for false advertising. and hope that HB shows them who the real boss is GL.

      well see if blizzard wasnt owned by activision ide be sorta ticked, but seeing as the "new" blizz let someone ninja 90k from me, numerous items and didnt do anything when my buddy got hacked, i really dont give a flying fuck im just waiting till GW2 and i hope u guys will cover that content too

      I am sure blizzard have alot up there sleeve to deal with cases like botting when they are ready

      I posted a while back on a few things

      Think of this going by blizzard your bot gets used for by cheaters low lifes computer hackers/aka gold sellers....NOW UNDER COMPUTER LAW THE TERM COMPUTER HACKING is where you do not have permission to access information on a owners computer...So you may want to be careful you know because computer laws could apply here

      Your point is irrelevant to this situation, Creating a program that automates game play doesn't touch the Blizzards systems, They are not hacking any files. To get the world information they ripped apart a copy of the game they bought and manipulated it to work in their way. They didn't break any security protocols or put their foot across blizzard servers to get the program to work. The only thing they manipulated was making the bot undetectable by warden, Which is also on YOUR system. You installed it. Your not *****in blizzard your hacking your self.
