      This thread is really irrelevant regarding this that matter- In fact going down this path would more the likely result in a permanent closure of ALL your battle.net accounts.

      This post is in reference to insuring blizzard has not broken any laws in a said country in regards to privacy- in some countries it appears they may have...

      So basically- if your wow account is your concern here and getting it unbanned- this thread is NOT for you.

      if you privacy is a concern- and want to ensure blizzard have not breached your privacy in your country- this tread IS for you.

      I don't know, I was told once by a superior court judge, once. when you are right, you are right. there might be some meat to this, but it would require everyone working together. but again, it might by why they chose to do a 6 month ban, and not permanently delete accounts.

      Some countries in EU have there own laws when concerning privacy(privacy comission). I assume the people in Belgium have watched the news last week? There government are actually making a case against Facebook because of datamining user information in the background. If they can do it with adjusting there rules with vague information, so can and will blizzard. I believe facebook has even more resources than Blizzard, no ? If a country says no in the EU, this means NO.

      The catch behind it is that the company, in this case blizzard needs to have a site located in its country(Belgium rules). This is sadly not the case i guess. But since the base of operation is in Francefor EU, i would guess the HB users in France could report this privacy matter onto there privacy comission and start from there.

      If you think Blizzard did this detection suddenly via a legal way, think again over what FB is doing. It might not be done legally.

      Clicking a checkbox for a EULA means nothing imo. If my handwritten signature or digital counterpart(cosign) is not under a document then it is not valid.

      My eyes hurt after reading all this. so far for me Blizz have responded to all my tickets trying to find out exactly what I did wrong. All i'm getting at the moment is that I was engaged in exploitative behavior. No mentions of botting specifically.

      I don't give a crap about a couple of botting accounts...

      I do care the blizzard thinks they can do what they want...

      If there is a legal avenue to go down- I'm going down it..

      In Australia you don't need money, you just need to prove your point.

      Jesus dude that's one thoroughly extensive post. The problem is that most of the people who will do this are just upset they got banned. They didn't care until they had negative reinforcement. That said, you are correct in that if something is personally identifying information you always have some control over how it is used. The thing is we probably waived those specific rights as well. Look at what the EU had to do to Google in order for them to agree to "the right to be forgotten" thing. Regardless of how interesting this is, its something to write your representatives in Federal and State government rather than try to fight personally.

      edit: wanted to add that i skimmed quite a bit of your posts as it was really extensive so if i'm off base just ignore this :)

      While it all sounds good, I'm going to go with No at this point. I need the break from this trashy game and if Blizz should do anything untoward during the ban just to make things worse, I don't want to be part of it. If this was an outright ban, you're damned right I would want to know since there's nothing left to lose; but I lost a main account here so I'm more interested in getting it back and moving forward.

      People seem to think that no individual could afford to sue blizzard over a video game, and while this may be true I have 3 words for you: Class Action Lawsuit. Multiple parties can and do often foot the bill for suing large companies, and if there are legal violation on blizzards part in order to find the information that prompted this detection then they are liable for any action they took, as much so as all the botters on this site

      Hmmm yea seems for EU players there maybe a loophole for Data Protection etc etc, has anyone found any useful Information for USA players

      The wording is important. Blizzard has a team of lawyers to write up their terms, while everyone here is an armchair lawyer.

      I remember people trying to use privacy laws to get bans reversed back during the Pirox days, and it never worked.
